LOCALPARETO LLC · LEGAL & PRIVACY

Terms & Conditions

LocalPareto LLC website, subscription, and SMS messaging terms for clients and visitors.

Arizona-based · Serving U.S. businesses

These Terms describe use of LocalPareto's website, its own messaging program, and its business subscription services. References to "LocalPareto," "we," "us," or "our" mean the business operator identified above.

LocalPareto operates from Arizona and serves business clients throughout the United States.

Scope and agreements

The website provides information about our services. A business subscription is established through the applicable service agreement and payment authorization. Browsing the website, submitting an inquiry, or receiving a text does not enroll you in a paid subscription.

Business clients must have authority to enter into their service agreement and authorize work on the accounts and information they provide. A written service agreement controls the specific configuration, responsibilities, and commercial terms where it differs from these general service descriptions, subject to applicable law. It does not override a message recipient's consent choices or non-waivable rights.

LocalPareto services

LocalPareto provides technology for managing a business's online presence and customer relationships, with setup and ongoing management by Emerson. Configured features may include local search and profile optimization, customer conversations and records, review requests, basic email and SMS automations, business-trained website AI, AI call assistance where needed, and a dashboard for connected activity.

Hosting, maintenance, and system management support continued use. Website and booking improvements are scoped around the business's needs; subscribing does not automatically include an unrestricted website rebuild or every available integration or platform capability.

The configuration and included upgrades are confirmed before setup. Service depends on the access, accurate information, approvals, and permissions needed to perform the agreed work.

Subscription and payment

The current standard LocalPareto subscription is $147 per month, billed automatically beginning when the client gets started. The recurring payment covers continued access to the configured LocalPareto system and its management, rather than only a completed website project.

Automatic billing requires the client's payment authorization. Any separately agreed charges or changes must be disclosed and agreed to as applicable; these Terms do not establish additional setup fees, usage charges, or unlimited usage allowances.

If a payment fails, LocalPareto will contact the client to resolve the outstanding balance and may pursue amounts lawfully owed. This does not establish additional collection fees or charges.

Cancellation and access

Contact Emerson@localpareto.com or call 928-433-8348 about cancellation or billing questions. Cancellation ends future subscription renewals. Any question about a payment already collected will be addressed under your service agreement and applicable law; these Terms do not establish a blanket non-refundable-payment rule.

Cancellation immediately ends access to subscription features, including automations, the portal, LocalPareto AI, and platform-held customer records and conversations. Platform data is deleted later, subject to applicable retention requirements and provider processes described in the Privacy Policy.

Website, domain, intellectual-property ownership, and any handoff arrangements are addressed in the client's written service agreement. These Terms do not promise that cancellation transfers a website, software license, or domain, or that access to platform data continues after cancellation.

LocalPareto SMS messaging program

Sender and message purposes

The LocalPareto messaging program is operated by LocalPareto LLC (LocalPareto), using 928-433-8348.

The program provides follow-up messages to LocalPareto clients about their requests and services. Enrollment is offered through the website chat widget. Messages must remain within the purposes disclosed and selected when the client opts in.

Consent and frequency

SMS participation is optional. Consent to marketing texts is not a condition of purchasing services. Providing a phone number, using the website, or accepting general service terms does not by itself constitute consent to marketing text messages.

Messages may be sent using automated technology. Message frequency varies based on the program you select and your interactions. Any more specific frequency disclosed when you opt in applies to that program.

Charges

Message and data rates may apply to messages sent or received. Ask your wireless provider about your plan. Carrier charges are separate from any LocalPareto business subscription.

Unsubscribe

Reply STOP to the number that sent the message to stop texts from that program. We may send one non-promotional confirmation, then stop further program messages unless you opt in again. You may also contact us to revoke consent or request assistance. Other clear opt-out requests will be handled as required by applicable law and platform capabilities.

To rejoin, complete the program's opt-in process again. A prior opt-out is not canceled by a website visit, purchase, or policy update.

Stopping text messages does not cancel a paid LocalPareto subscription. Use the subscription cancellation process to end paid service.

Help and delivery

Reply HELP for assistance, email Emerson@localpareto.com, or call 928-433-8348. Delivery depends on carrier networks, device compatibility, and service availability. Carriers are not liable for delayed or undelivered messages. Do not use this program for emergency communications.

Number changes and privacy

Only enroll a number you are authorized to use. Notify us if you give up or change an enrolled number so we can update your preferences.

Information associated with the program is handled under the LocalPareto Privacy Policy: Privacy Policy.

Messages sent by client businesses

A business using LocalPareto remains responsible for identifying itself as the sender, establishing its messaging purposes, obtaining and documenting appropriate consent, maintaining accurate disclosures, and honoring opt-outs. LocalPareto provides and manages technology under the agreed scope; use of the system does not itself create recipient consent or guarantee regulatory compliance.

Client businesses must not use purchased, rented, scraped, or otherwise unauthorized contact lists for messaging. Consent to hear from one business is not permission for another business to send marketing messages. Suppression and opt-out preferences must be respected when importing, connecting, or updating customer records.

Client businesses must provide their own applicable privacy policy, messaging terms, and opt-in disclosures. A customer receiving a client's messages should contact that business about its products, appointments, payments, refunds, or messaging program. That customer does not owe LocalPareto a subscription fee merely because their business uses our technology.

Client accounts, information, and acceptable use

Clients are responsible for providing accurate business information, securing their authorized-user accounts, and having the rights and permissions needed for content and data supplied to the system. Access must be limited to authorized people.

Do not use LocalPareto to send unlawful or deceptive communications; impersonate another party; bypass consent or opt-out controls; post fabricated reviews; infringe intellectual-property or privacy rights; distribute malware; or access systems without authorization.

Do not submit regulated or highly sensitive information unless the parties have expressly established that the service configuration and required agreements support that use. General chat, messaging, and AI tools are not emergency services.

AI assistance and third-party services

AI features can produce incomplete or inaccurate answers. Clients should provide accurate business instructions, review their configurations, and arrange human follow-up where appropriate. Customers should confirm important information directly with the relevant business.

Third-party platforms, carriers, hosting, search engines, payment processors, and integrations operate under their own applicable terms and technical limitations. Availability and functionality may change. Any third-party charges payable by the client must be disclosed through the applicable service arrangements; this section does not independently authorize additional charges.

Results and service limitations

LocalPareto does not guarantee a particular search ranking, review score, volume of inquiries, revenue result, uninterrupted service, or delivery of every message. We work to configure and manage the agreed technology, but results also depend on business operations, customer behavior, accurate information, competition, and third-party systems.

Nothing in these Terms excludes obligations or rights that cannot lawfully be excluded. Any additional terms agreed in writing remain subject to applicable law.

Changes and contact

We may update website and program information as services or requirements change. Material changes affecting an existing subscription will be communicated and handled under the applicable agreement and law. An update does not retroactively authorize charges or expand a recipient's messaging consent.
